Commissioner Hiers didn\u2019t let that pass without notice.<\/p>\n\n\n\n<p class=\"has-black-color has-text-color has-link-color wp-elements-36e348965d76929c33b859ed91536ac0\">\u201cWe\u2019re at a big difference on prices\u2026\u201d<\/p>\n\n\n\n<p class=\"has-black-color has-text-color has-link-color wp-elements-10ad5afc46f1f1b637d0970e26f0d18a\">Commissioner Kennedy also stayed engaged as the numbers were read into the record.<\/p>\n\n\n\n<p class=\"has-black-color has-text-color has-link-color wp-elements-daddac6bb9154fa9d05053570152445e\">The issue was clear:<br>How can one company perform the same work for roughly half the cost?<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<p class=\"has-black-color has-text-color has-link-color has-medium-font-size wp-elements-c6ab1f1f5deb8df9544f4621cb6ad5c1\"><strong>The Answer That Wasn\u2019t \u2014 and What Was Missing<\/strong><\/p>\n\n\n\n<p class=\"has-black-color has-text-color has-link-color wp-elements-85ac4b54df22819def73acda78dc11b0\">Public Works Director Matt Weldon responded:<\/p>\n\n\n\n<p class=\"has-black-color has-text-color has-link-color wp-elements-4ca37c3edae392fa6960aa5b336c7536\"><strong>\u201cIt could depend on how busy those other companies are.\u201d<\/strong><\/p>\n\n\n\n<p class=\"has-black-color has-text-color has-link-color wp-elements-5ec9c9384d090c708fd4c59a1a947fe8\">For a gap of more than $500,000, the response came across as dismissive of a serious question \u2014 one that goes directly to how taxpayer dollars are being spent.<\/p>\n\n\n\n<p class=\"has-black-color has-text-color has-link-color wp-elements-33f889e702de722451d32468472e7d92\">Sitting in the audience, the response came across as flippant and, given the size of the gap, felt like a slap in the face to the question raised by Commissioners Hiers and Kennedy and to the taxpayers footing the bill.<\/p>\n\n\n\n<p class=\"has-black-color has-text-color has-link-color wp-elements-ba4090b04da71324869c12b963281b35\">And while this project is funded through a grant, that doesn\u2019t make it free money; it\u2019s still taxpayer dollars, just coming from a different pocket.<\/p>\n\n\n\n<p class=\"has-black-color has-text-color has-link-color wp-elements-084ff58085d0cb80585770d88d264cf7\">Hiers and Kennedy weren\u2019t asking a casual question. They were asking why one company could come in dramatically lower on the same project.<\/p>\n\n\n\n<p class=\"has-black-color has-text-color has-link-color wp-elements-c670fe8d202e03a76ac09adabd76ea42\">Instead of a clear explanation \u2014 scope, costs, or how the bids compared \u2014 the question was never actually answered.<\/p>\n\n\n\n<p class=\"has-black-color has-text-color has-link-color wp-elements-882a2f8cb6da23228f2a798617147bb9\">If a gap this large doesn\u2019t get a clear answer before approval, what does? And what does that say to the other bidders, were all bids evaluated on the same basis?<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<p class=\"has-black-color has-text-color has-link-color has-medium-font-size wp-elements-bd4bf62d6fc9f6eb36da3e0f01855f5b\"><strong>The Bigger Issue: What Happens After Approval \u2014 A Higher Final Bill<\/strong><\/p>\n\n\n\n<p class=\"has-black-color has-text-color has-link-color wp-elements-a61061c0afceb6a24f3fc49abae145ad\">The bid documents show this contract includes standard provisions for:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li class=\"has-black-color has-text-color has-link-color wp-elements-b65f0bfdf10af926726bca32f5c4f42d\">Change orders<\/li>\n\n\n\n<li class=\"has-black-color has-text-color has-link-color wp-elements-b1e8ea1514acfee03b5978407ea66411\">Work change directives<\/li>\n\n\n\n<li class=\"has-black-color has-text-color has-link-color wp-elements-ee1aa5d20b5eaf465d15fe7d257a3159\">Adjustments to quantities as needed<\/li>\n<\/ul>\n\n\n\n<p class=\"has-black-color has-text-color has-link-color wp-elements-5671f8fead7400ac3df1ce526901b48a\">Those provisions allow the project scope and cost to be modified after approval. But what was not discussed at the meeting is what matters most to taxpayers:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li class=\"has-black-color has-text-color has-link-color wp-elements-d28b446abf78cc18c1d7c82690fa6201\">Who approves those changes?<\/li>\n\n\n\n<li class=\"has-black-color has-text-color has-link-color wp-elements-e8da35ea209c9a6e7ab55af74accb90d\">At what point do they come back before the Board, if at all?<\/li>\n\n\n\n<li class=\"has-black-color has-text-color has-link-color wp-elements-f597e78a42a618ff7ed9d7bfa82eaca1\">How are those increases tracked and reported to the public?<\/li>\n<\/ul>\n\n\n\n<p class=\"has-black-color has-text-color has-link-color wp-elements-73e1703e99e04d5aa7228e543e7f9e9b\">Because once a project is approved, cost increases do not come back as a new bid. They come back, or don\u2019t, as change orders.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<p class=\"has-black-color has-text-color has-link-color has-medium-font-size wp-elements-bb7c06d8ad41b2354ab164133bd8a695\"><strong>How a Bid Becomes a Bigger Bill<\/strong><\/p>\n\n\n\n<p class=\"has-black-color has-text-color has-link-color wp-elements-55fbf6bbe840c92bcb645bf3bba1d97f\">The price approved by the Board is based on the initial scope of work. But contracts like this include change orders. A change order allows additional work, &nbsp;and additional cost, to be added after the contract is approved.<\/p>\n\n\n\n<p class=\"has-black-color has-text-color has-link-color wp-elements-48483a61c47ad3a2e10fbc16b5c6dedc\">Those changes can come from:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li class=\"has-black-color has-text-color has-link-color wp-elements-3b4802fd66522b31fd1995fab847a10d\">Field conditions<\/li>\n\n\n\n<li class=\"has-black-color has-text-color has-link-color wp-elements-c002ff64d3cc9812218c4d4c390bc4b7\">Additional work<\/li>\n\n\n\n<li class=\"has-black-color has-text-color has-link-color wp-elements-fbca9612692533138a694d8af854f07d\">Increased quantities<\/li>\n\n\n\n<li class=\"has-black-color has-text-color has-link-color wp-elements-487ef69cf2b1b658c8850912d0dfe974\">Project adjustments<\/li>\n<\/ul>\n\n\n\n<p class=\"has-black-color has-text-color has-link-color wp-elements-710f118acec9a9dc1e4ceeb6e570128f\">They are not part of the original bid. They are added later. When a project starts with a bid significantly lower than others, the real question is:<\/p>\n\n\n\n<p class=\"has-black-color has-text-color has-link-color wp-elements-07f3aac5d82bf9c0e45cb2f6cd066206\">Does that number hold, or grow over time?<\/p>\n\n\n\n<p class=\"has-black-color has-text-color has-link-color wp-elements-822aa7addecd51cfa1fa963c039d1ef8\">What was not discussed:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li class=\"has-black-color has-text-color has-link-color wp-elements-d27e883679cc817011cfca28885c770c\">What triggers those changes<\/li>\n\n\n\n<li class=\"has-black-color has-text-color has-link-color wp-elements-3b1d702a5cd293fcc358011a09ec9f84\">Who approves them<\/li>\n\n\n\n<li class=\"has-black-color has-text-color has-link-color wp-elements-5c89fb8d44a6224cabafc622d7b97846\">Whether they return to the Board<\/li>\n<\/ul>\n\n\n\n<p class=\"has-black-color has-text-color has-link-color wp-elements-dde0f617c457d23cef92aed19ad76b21\"><strong>A low bid sets the starting number. Change orders determine the final cost.<\/strong><\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<p class=\"has-black-color has-text-color has-link-color has-medium-font-size wp-elements-d6f9966a7729afb2b311b0bc59abaef6\"><strong>Where Is the Accountability \u2014 or Is There a Back Door?<\/strong><\/p>\n\n\n\n<p class=\"has-black-color has-text-color has-link-color wp-elements-894674c40c1c33000e6eb1339bd3bee0\">If a significant bid gap is identified but not explained before approval, how is the process protecting taxpayers?<\/p>\n\n\n\n<p class=\"has-black-color has-text-color has-link-color wp-elements-7490d0551fe395dacd070df9805f41be\">Key questions remain:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li class=\"has-black-color has-text-color has-link-color wp-elements-70a48d143418b5f0f336ad95926bcb23\">Who reviews and approves cost increases?<\/li>\n\n\n\n<li class=\"has-black-color has-text-color has-link-color wp-elements-4096c0b8680b3b0993186a4e3bb73ee8\">When do those increases return to the Board?<\/li>\n\n\n\n<li class=\"has-black-color has-text-color has-link-color wp-elements-ea55c02235029fb3c268067d69dc2d38\">What role do procurement and finance play?<\/li>\n\n\n\n<li class=\"has-black-color has-text-color has-link-color wp-elements-8a9b31c03ddb174fb1104e48f02f219c\">How is the total cost tracked and reported?<\/li>\n<\/ul>\n\n\n\n<p class=\"has-black-color has-text-color has-link-color wp-elements-0a8b49a67641830e947b1a787bf2ffc7\">These are not technical questions. They go directly to:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li class=\"has-black-color has-text-color has-link-color wp-elements-23d76dff1a7bc12517d442afbb60f8da\">Bid integrity<\/li>\n\n\n\n<li class=\"has-black-color has-text-color has-link-color wp-elements-ad3418a71cd4fce0c47b62c1e3d60626\">Fair competition<\/li>\n\n\n\n<li class=\"has-black-color has-text-color has-link-color wp-elements-4615421c1f69ba1a49f5fca4b1210efe\">Protection of taxpayer dollars<\/li>\n<\/ul>\n\n\n\n<p class=\"has-black-color has-text-color has-link-color wp-elements-0fcbe1b6200598eaa58221eef1afc0a4\">And they lead to a concern many taxpayers will recognize:<\/p>\n\n\n\n<p class=\"has-black-color has-text-color has-link-color wp-elements-aa7cc0615a913773b8f3c5b9b7483470\">If the lowest bid is approved without a clear explanation, does the process allow costs to come in later, through the back door of change orders?<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<p class=\"has-black-color has-text-color has-link-color has-medium-font-size wp-elements-ce10cfc5500f999e56213a94a08c4dad\"><strong>What Comes Next<\/strong><\/p>\n\n\n\n<p class=\"has-black-color has-text-color has-link-color wp-elements-89f1b8dd78d533a85456edc7c977498c\">The project has now been approved.  But the real test will be what happens next,  as costs are managed, approved, and tracked through completion.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<p class=\"has-black-color has-text-color has-link-color has-medium-font-size wp-elements-6282b9666d0374716964efd66a185379\"><strong>Watchdog Quick Check<\/strong><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li class=\"has-black-color has-text-color has-link-color wp-elements-6b46f3c0f52e289197d59a3fe0dd71e2\">Why was the lowest bid $500K lower?<\/li>\n\n\n\n<li class=\"has-black-color has-text-color has-link-color wp-elements-96cd6aea2b660b924e86a69583087dc0\">Were all bidders pricing the same scope?<\/li>\n\n\n\n<li class=\"has-black-color has-text-color has-link-color wp-elements-3162a853d3853dd3523122636eb93770\">What triggers a change order?<\/li>\n\n\n\n<li class=\"has-black-color has-text-color has-link-color wp-elements-d28b446abf78cc18c1d7c82690fa6201\">Who approves those changes?<\/li>\n\n\n\n<li class=\"has-black-color has-text-color has-link-color wp-elements-eb69ae4c1b9a2283b83f1b4b257139fb\">Will the final cost be publicly tracked?<\/li>\n<\/ul>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<p class=\"has-black-color has-text-color has-link-color has-medium-font-size wp-elements-70ecd42b90c7ef5c2e38779f5763aa1c\"><strong>Bottom Line<\/strong><\/p>\n\n\n\n<p class=\"has-black-color has-text-color has-link-color wp-elements-51c0d50a6b6e8d501fb2182300ffeb43\">Commissioners Hiers and Kennedy did what taxpayers expect. They asked the question. The answer didn\u2019t match the seriousness of the issue. And the vote moved forward without clarity on how future costs will be handled.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<p class=\"has-black-color has-text-color has-link-color has-medium-font-size wp-elements-2093705e3cc221ebcb4ef84a28faa045\"><strong>Closing<\/strong><\/p>\n\n\n\n<p class=\"has-black-color has-text-color has-link-color wp-elements-808a5589d52aabafc436caf391e79562\">Commissioners Hiers and Kennedy flagged a real issue. This bid, and how it was evaluated, needs a follow-up. Because this goes beyond one project.
