Press Release: Court Order quashing the approval of the 3RT Sand Mine Special Exception
On Tuesday, September 17, 2024, the Circuit Court of the Eighth Judicial Circuit in and for Levy County, Florida, issued an order quashing the approval of the 3RT Sand Mine Special Exception. “Quash” means that the approval for the 3RT Sand Mine was voided.
The Court’s order quashing the approval of the 3RT Sand Mine Special Exception means that the property owner does not have approval to develop and operate a sand mine.
The County is in the process of reviewing the order.
Spotlight has Questions
- Entitlement to Damages: Is the 3RT (Thomas family) entitled to recover expenses for providing flashing “caution trucks entering road” signs, engineering costs, letters sent to residents, and other costs to meet all the criteria for the 3RT sand mine to come before the BoCC if the order to quash stands?
- Public Access to Information: Where is a copy of the documents the county is reviewing? The public would like to review as well. A bare-bones press release is not good enough.
- Public Disclosure if Court Fight: Will the public be provided details when or if the County fights the court order?
